Lane & Waterman successfully defends City of Davenport in Employment Lawsuit

The City of Davenport, Iowa, represented by Lane & Waterman attorney Ben Patterson, recently obtained a favorable decision in the Scott County District Court. A Davenport firefighter, represented by Mike Meloy, filed a lawsuit claiming he was wrongfully passed over for promotion. The firefighter sought promotion with back pay. The lawsuit claimed Iowa law required the City to use the Civil Service Commission’s certified promotional list for three years instead of two. Scott County District Court Chief Judge Marlita Greve granted the City’s Motion for Summary Judgment dismissing the lawsuit. Judge Greve agreed with the City’s argument that the plain language of the applicable Iowa Code section only required the list be used for two years.
